1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Sichuan Puciyun Technology Co., Ltd ("Puciyun," "Company," "we," "our," or "us"). By accessing and using our website (puciyun.com), mobile applications on Google Play Store and Apple App Store, and related services ("Services"), you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use our Services.

2. Eligibility and User Requirements

2.1 Age Requirements:

Users must be at least 13 years of age (or the applicable age of digital consent in their jurisdiction)
Users under 18 may use Services only with parental or guardian consent
Users under the age of legal majority must have legally binding parental/guardian agreement to these Terms
We reserve the right to verify age and may request documentation as proof of age compliance

2.2 User Responsibility:

You are responsible for providing accurate and complete information
You agree to maintain confidentiality of account credentials
You are liable for all activities under your account
You must comply with all applicable laws and regulations

3. Account Registration and Security

3.1 Registration Requirements:

Accurate and truthful information provision is mandatory
Passwords must be secure and confidential
Account is non-transferable and personal
One account per user unless otherwise authorized

3.2 Account Security:

Users are responsible for protecting account credentials
Notify us immediately of unauthorized account access
We are not liable for unauthorized access resulting from user negligence
We may suspend accounts with suspected security compromise

4. Intellectual Property Rights

4.1 Ownership:All content, software, designs, graphics, images, and materials on our Services are owned by or licensed to Puciyun and are protected by international copyright, trademark, and other intellectual property laws.

4.2 License Grant:We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for personal, non-commercial purposes only, subject to these Terms.

5. User Content and Conduct

5.1 User-Generated Content:You retain rights to content you create, but grant Puciyun a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute your content for service improvement and operations.

5.2 Prohibited Conduct:You agree not to:

Upload or transmit viruses, malware, or harmful code
Harass, threaten, defame, or libel other users
Violate intellectual property rights of third parties
Engage in unauthorized access or hacking attempts
Spam, phish, or conduct fraudulent activities
Violate laws or regulations
Post illegal, obscene, or adult content (especially regarding minors)
Circumvent security mechanisms
Crawl or scrape website content without permission

6. Application Store Compliance

6.1 Google Play Store Requirements:

Applications comply with Google Play Developer Program Policies
Applications comply with Google Play Store data collection and advertising policies
All declared permissions are justified and minimal
User data is treated securely and in compliance with privacy laws
Applications undergo regular security updates and vulnerability patching
Compliance with content policies for all app types and rating categories
Adherence to monetization policies including ads quality and placement
User ratings and reviews are monitored for quality and authenticity

6.2 Apple App Store Requirements:

Applications comply with App Store Review Guidelines
Privacy practices disclosed accurately in App Store Connect
App Tracking Transparency (ATT) compliance for tracking requests
Privacy labels accurately reflect data collection practices
Child safety measures implemented for age-appropriate content
Applications function as described without misleading users
Compliance with content rating system (IARC) guidelines
Regular updates addressing bugs, security issues, and performance

6.3 Cross-Platform Compliance:

Services available on multiple platforms maintain consistent privacy protections
Terms apply uniformly across website and mobile applications
Data handling practices consistent across all platforms
User rights protected equally regardless of access platform

7. Advertising and Commercial Content

7.1 Advertisement Display:Our Services contain advertisements served by Puciyun and third-party advertising networks including Google AdMob, Facebook Audience Network, AppLovin, Unity Ads, Chartboost, Vungle, Mintegral, TikTok Audience Network, and InMobi.

7.2 Third-Party Advertising Terms:

Third-party advertisers are responsible for ad content accuracy
Puciyun is not liable for fraudulent or misleading advertisements
Users click ads at their own risk
We do not endorse products or services advertised by third parties

7.3 Rewarded Advertising:Apps may offer rewards for watching video advertisements. Users voluntarily engage with rewarded ads and accept any data collection by ad networks associated with this engagement.

8. Limitation of Liability and Disclaimers

8.1 AS-IS Disclaimer:Our Services are provided "as is" without warranties of any kind, express or implied. We do not warrant:

Uninterrupted or error-free service operation
Accuracy, completeness, or reliability of all information
Fitness for particular purpose
Third-party product or service quality

8.2 Limitation of Damages:To the maximum extent permitted by law, Puciyun shall not be liable for:

Indirect, incidental, special, or consequential damages
Lost profits, revenue, or data
Damages exceeding amounts you paid us (if applicable)
Third-party claims or actions resulting from your use of our Services

8.3 Service Interruption:We shall not be liable for service interruptions caused by:

Natural disasters, war, or terrorism
Government action or regulations
Third-party network or service failures
Circumstances beyond our reasonable control

9. Indemnification

You agree to indemnify, defend, and hold harmless Puciyun, its officers, directors, employees, and agents from any claims, damages, or costs (including legal fees) arising from:

Your violation of these Terms
Your violation of applicable laws or regulations
Your use of our Services
Content you create or upload
Your infringement of third-party intellectual property rights

10. Termination and Account Suspension

10.1 Termination by Users:You may terminate your account by contacting us at support@puciyun.com. Upon termination, your right to use the Services ceases immediately.

10.2 Termination by Puciyun:We may suspend or terminate your account if we determine you have:

Violated these Terms or any policy
Engaged in illegal or fraudulent activity
Violated intellectual property rights
Harassed or threatened other users
Failed to comply with regulatory requirements

10.3 Effect of Termination:Upon termination, your access to Services ceases. Survival of provisions: Sections concerning intellectual property, limitation of liability, indemnification, and governing law survive termination.

11. Modification of Terms and Services

We may modify these Terms or our Services at any time. Continued use of our Services following notification constitutes acceptance of modifications. For material changes, we will provide 30 days' notice via email or website notification.

12. Third-Party Links and Services

12.1 External Links:Our Services may contain links to third-party websites. We are not responsible for third-party content, accuracy, or practices.

12.2 Third-Party Services:Third-party services and content are provided "as is" without our warranty or endorsement.

13. Payment Terms and Refunds

13.1 Billing:Any fees for premium services will be clearly disclosed before purchase. Charges are automatically renewed unless cancelled.

13.2 Refund Policy:

Refunds processed within 7-14 business days of approval
Refund eligibility determined on case-by-case basis
App Store refunds subject to store policies (Google Play, Apple App Store)
No refunds for services rendered or content downloaded

13.3 Taxes:You are responsible for any applicable taxes. We are not responsible for calculating or collecting taxes based on your location.

14. Governing Law and Dispute Resolution

14.1 Governing Law:These Terms are governed by the laws of the People's Republic of China, without regard to conflict of law principles. However, provisions are subject to applicable local laws of user jurisdiction.

14.2 Jurisdiction:For users in the European Union, disputes are governed by GDPR and local EU member state laws. For California users, California law applies to disputes.

14.3 Dispute Resolution:

First, attempt to resolve disputes through customer support
For unresolved disputes, pursue negotiation in good faith
Binding arbitration may apply for certain disputes (except for intellectual property claims)
Class action waiver: Disputes resolved individually, not as class actions

14.4 Arbitration:Disputes shall be resolved by binding arbitration under applicable arbitration rules, with arbitration conducted in English. Arbitrator decisions are final and enforceable in courts.

15.1 Users Under 13 (COPPA Compliance):

Parental or guardian consent required for use
Minimal data collection from child accounts

15.3 Users 18+ (Adult Terms):

Full access to all Services features

16. International Compliance

16.1 Export Controls:Services may be subject to export control regulations. Users agree not to access Services from prohibited jurisdictions or for prohibited purposes.

16.2 Sanctions:Services not provided to individuals or entities subject to international sanctions.

19. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Puciyun regarding the use of our Services and supersede all prior communications and agreements.

20. Severability

If any provision of these Terms is deemed invalid or unenforceable, such provision shall be reformed to the minimum extent necessary, or if impossible, severed, and the remaining provisions shall remain in full effect.

21. Waiver

Failure to enforce any provision of these Terms does not constitute waiver of that provision or any other provision. Our waiver of any breach does not waive any subsequent breach.

22. No Third-Party Beneficiaries

These Terms are solely for the benefit of Puciyun and you. No third party has any rights or claims under these Terms.
